Council threatened to break down door to service boiler

COUNCIL officials threatened to break down a woman's door to carry out vital safety checks on her boiler – despite them being done two months earlier.
Christine Dumonceau was accused of persistently refusing the council entry to her home, even though she had an inspection carried out and certificated in July.

The 43-year-old was horrified to be issued with a notice last week threatening forced entry to her two-bedroom bungalow, as well as a £200 bill to cover the council's inconvenience.

She said: "There was a knock at the door and a man handed me a letter from the council, telling me he had been told to deliver it. I couldn't believe what it said. I tried to show him the inspection certificate, but he wasn't interested."

Ms Dumonceau has lived in her council house on Niddrie Mains Road for nearly three years. Every year the council arranges essential health and safety checks to her boiler and this year was no exception.

She said: "I got notification in July to say a service was needed so arranged a date.

"On July 9, a worker arrived, serviced my boiler and was gone in 45 minutes. There were no problems."

The council letter claimed they had made "several attempts" to arrange a date, as well as hand delivering a letter advising her of the need to allow workers access.

To add insult to injury, when Ms Dumonceau contacted the council on Monday to complain about the threatened legal action, she was told there were no records of her boiler being serviced. Staff insisted she fax the certificate to the authority to ensure the threatened action – scheduled for two days later – would be stopped.

She said: "I was so upset. I actually had to prove I was telling the truth."

The French-born resident, who has lived in Edinburgh for 22 years, hit out at the amount of money and time wasted due to an administrative error. She said: "The council disturbed the court, lost paperwork and wasted a lot of money, never mind treating me like a criminal.

"I have never once had an apology or been offered an explanation for the trouble."

A council spokeswoman said: "Unfortunately, there may have been an administrative error in relation to a boiler check being carried out at this property.

"However, we are planning to meet with Ms Dumonceau to go through paperwork to establish the statutory health and safety maintenance work is up to date. We apologise if there has been some confusion and hope to rectify the situation as soon as possible."

No, its the council's door. If you dont like their rules, rent elsewhere, or buy a house.

Be gratefull you got a place. Many people would love to have a house with a fully serviced, working boiler

#4 ypu may have rights, but renting from the council means you forgo some rights. If you want to be treated the same as everyone else, then buy a place.

1, 2 and 5 you really should not have access to a computer for the trash you write!

Council tenants - if they are decent working people and most are - have a right to be treated with respect like you or I.

The council do lose papers and their admin is appauling so before issuing all this paperwork they should have ascertained the information the lady had was correct first.

As for the three of you making comments - grow up before making any more or perhaps you on at this time of day it should be get a job!

As for the gas people/council story - surely once they saw the certificate the lovely staff at ECC apologied & sent the French lady a box of milk tray?

what a load rubbish,I had a similar problem with the gas board I arranged for someone to call at my flat to recheck my metor (It had been checked 4 times previously) why do people feel the need to contact the newspaper (is it to get your picture spread all over Edinburgh to show how stupid you are)

Im not sure why this council tenant feels this needs to be published in the local newspaper.
I can smell a hint of compensation coming on.
A similar incident happened to me with elec co. I got back from a funeral down south to find a letter informing me that I hadnt paid my leccy bill(i had) and the elec co would be breaking my door down the next day.
One heated phonecall later and a few threats from me and everything was sorted. I own my house but the leccy co own the meter however they were in the wrong.

Funnily enough I didnt tell the EEN or the sun or the mirror etc .

I once got a letter from the gas company telling me they were going to smash down my door and replace my meteor. I told them I was happy with the meteor but if they had other junk from outer space, I would gladly take it. I also had to phone them to tell them not to smash down my door as the meteor did it when it landed on my house.

I am utterly and completely amazed at this story! Who has the right to break anyone's door down, except the Police when running a raid or looking for a murderer. No one in this country could do that! Even if you have one of those things to call an ambulance,when you're old and the ambulance comes, if your door is locked they CANNOT enter your apartment or home! Outrageous behavior to break someone's door down by force!!!

A couple of years ago, the council threatened to send bailiffs to collect community tax from college students, all because the list the college had sent them had become lost.

Students had to go down to the council offices/bailiffs office and show them both a signed certificate confirming that they were indeed students.

What happened to that guy who had all his poessessions thrown out (including family photographs) all because the council workers got the wrong flat?
