Timeshare owners up the ante

THE row over soaring charges at holiday points club Diamond Resorts International has intensified following last week's Scotland on Sunday article (Give me a break from soaring timeshare fees), writes Teresa Hunter.
A group of readers decided to seek legal advice about how they can extricate themselves from the scheme, which has seen annual management charges rise by nearly 40%.

Meanwhile, the Timeshare Association, a consumer group that represents timesha
re owners, has entered the fray, claiming the holiday propositions as sold were never financially viable.

When points-holders invested thousands of pounds into the timeshare club, they were told they would have to pay annual management fees of a few hundred pounds. Now these have risen to anything from £650 to £1,000 a week or more.

Many readers bought their points from the Grand Vacation Club, which was subsequently taken over by DRI. But according to the Timeshare Association, participants were not given a true picture about the costs from the outset.

A Timeshare Association spokesman said: "The annual fees were never realistic, but were initially subsidised and kept low simply to sell the schemes.

"The previous company subsidised the points club to the tune of £4m annually. However, this subsidy stopped last year.

"On top of this the industry has been hit by a number of factors. The first is the currency situation. The second factor is age. The main income of a resort is the annual management fee. The majority of European resorts were built in the Eighties for the then 'empty nesters', so the industry is facing aged resorts; these clearly now require refurbishment."

The suggestion that points-owners were sold a holiday investment that was never viable raises serious questions about the initial proposition.

Meanwhile, the major concern for points-owners is how to extricate themselves from contracts which lock them into rising fees until 2054.

A group is now intending to seek a legal opinion regarding their contracts. They have asked if Scotland on Sunday would act as a clearing house to forward details of any other readers who would like to join them. As you know, our company has indeed formally responded to your comments, many of which were simply inaccurate and ill-informed. I will not address the details in this e-mail as that has been done in the formal response. Needless to say, Diamond Resorts International ® is very concerned and indeed disappointed that you have seen fit to provide inaccurate information to our owners and members without apparently having even a basic understanding of our Company or any of the services and products that we provide. It does not speak well to your publication’s objectivity or desire to uncover the facts before putting “pen to paper”.

However, I did want to address one comment whereby it was suggested that an attempt has been made on numerous occasion to contact Diamond Resorts International ® without any success.

I find that hard to believe. Please let me know specifically who you attempted to contact in our organization. I will ensure that if this lack of responsiveness did indeed occur, it will immdiately be rectified and will not occur again.

Any owner or member with Diamond Resorts International ®, or any member of the press, who writes to me will always receive a response in a timely fashion – usually within 24 hours. This will not be an automatically generated e-mail response, but will be a response from me personally addressing the specifics of each situation.

Well Mr Simon Crawford-Welch, as a member of DR I can speak from experience that DR has far from delivered the exemplary service (including)communicating with members that I understood that I had bought into.
I have emailed your Chair/CEO three times without response. Hardly a good example for DR staff!
I thought that I was involved in a club that operated with openness, care and integrity and to impose a charge for points on the management fees without warning is a complete disgrace as is the lack of response from your Chair.
Perhaps Mr Cloobeck is 'sunning' himself in one of our resorts that members can never seem to book!

On the basis of what Ive seen here and on the Daily Mirror Investigation Web Site Mr. Crawford-Welch should have a full 'e' mail box by now.

I 'e' mailed him late yesterday with full details of my unanswered Contacts with DRI in Lancaser by 'e' mail and Recorded Delivery Letter, with the DRI Webmaster and with guess who. You get on go. Yes it was Mr. Cloobeck the Chief Executive Officer of DRI. I 'e' mailed him from the DRI website on the evening of 2nd January and you now get one chance to guess what happened.
Your all correct, I got no response what so ever.

Now I did received an 'e' mail response from Mr. Crawford-Welch within 5 minutes of mine going out to him so that is certainly an improvment.
He has promised me that I will get a full response within 2 days or so!!!!
THE CLOCK IS TICKING.

Further to my 'Post' above the Readers of this Forum who have not seen the Daily Mirror Investigation Web Site might want to and look at it because its developing well with 50 to 60 contributions and the comments etc will, I am sure, be of use to our Scottish Friends.

Couldn't you as a well known and respected newspaper take up this cause, not just for the UK, but for the whole of the European membership. If you couldn't afford it, ask for contributions from each person who wanted to get out of the 'DRI' sham on the agreement that when it was resolved, the people who had contributed got their money back, via 'costs being awarded against DRI', which I am sure they would be.

Like others we will not be paying our fees for 2009, we will also be looking to join an action group to look into ways of terminating our membership.
Has any else had problems leaving a message on any of the Daily Mirror blog sites it does not like my text?

Further to the Mirror blogs (there's two of them) reference, the firm of solicitors that are looking to forward copies of DRI members contracts to a barrister (to see where they stand re: maintenance increases) are looking to collate all of the contracts for sending by the end of this month.
